STJ Minister calls for attention with cryptocurrencies as a parallel market

Last Thursday (9) the VIII National Forum of Federal Criminal Judges (FONACRIM) began. At the opening of the event, a Minister of the STJ asked for attention to the cryptocurrency market, which has been increasingly used in crimes, according to him. This event is exclusive to federal judges in Brazil, who undergo a process of professional updating and are aware of trends in the judiciary. In this training, federal criminal judges underwent training on cryptocurrencies last Thursday, with a lecture on the topic, in a process that shows ongoing education on the topic for higher court magistrates on this topic. It is worth remembering that there is still no regulation on the topic of cryptocurrencies in Brazil approved, which leads the judiciary to decide disputes in this sector.

With Latin America drawing attention due to the great demand for cryptocurrency technology, Brazil ended up standing out in the market, not because it is the largest in the region, but because it holds the most expressive volume of negotiations in this sector. This leads to the country an interest from companies in the sector that want to work with cryptocurrencies, which is now a growing reality for business. Companies such as Mercado Livre and Nubank already allow their customers to buy and sell cryptocurrencies, showing that adoption remains firm in the country. However, for the vice-president of the Superior Court of Justice (STJ), Jorge Mussi, attention is needed with the growth of the parallel cryptocurrency market, which has been used for crimes.

“I cite the peculiar situation of facing the contingencies of the use of cryptocurrencies, which show the movement of large amounts in this parallel market, all without proper regulation, which generates concern for all those who are obliged to face this issue.”

The Minister’s speech took place during the opening of the event and at a time when he was talking about the difficulty of criminal legislation to keep up with the speed of changes in the criminal universe. Thus, there are legal gaps that are challenges for the judge’s performance. In the case of cryptocurrencies, the STJ Minister recalls that they have been used in crimes against the financial system. In addition to digital currencies, the event also focused on discussing financial pyramids. This Friday (10), the event continues with topics such as money laundering, tax havens, among others, which are also challenges for the STJ.

STJ reinforces literary collection with 4 acquisitions on the subject of blockchain and cryptocurrencies

To understand more about the subject, the institutional library of the STJ reinforced the literary collection at the end of May on the topic of cryptocurrencies and blockchain. According to a consultation made by the livecoins, the new acquisitions are of books on various subjects. One of the works acquired is “Criptoativos Estudos Regulatórios e Tributários”, which talks about ICOs and the CVM regulatory Sandbox. There are also books on the use of smart contracts, on the commercial use of cryptocurrencies and blockchains, among others.
